You are permitted to reproduce, copy, distribute and print out the Viking online shop. However, this only applies to the following instances:

1. To place an order with Viking.

2. To use the Viking home page as a shopping source, provided that you do not edit the online shop and that you observe all copyrights and reservations of title.

General terms and conditions of Office Depot Deutschland GmbH (Viking)

Our offers are intended exclusively for industry, trades, commerce and professions, whether in a self-employed, professional or commercial capacity. These offers are not available for wholesalers or resellers of office items.

Sales and delivery are carried out exclusively within Germany.

Sales and deliveries from Viking are carried out exclusively in accordance with the respective general terms and conditions. The current version of the GTC can be found under agb.viking.de. By placing an order or receiving a delivery, you are agreeing to these terms. These terms are applicable to all business that you conclude with us in future.

Cafissimo products are sold on behalf of and for account of Tchibo GmbH.

The inclusion of deviating and/or supplementary terms and conditions of the customer to the present general terms and conditions will not be accepted. This stipulation also applies in the event that no explicit objection is raised by us at the time of accepting individual orders.

The contract text is not stored by Viking when an order is placed. This cannot be retrieved after completion of the ordering process. However, order information can be printed immediately after an order is submitted.

German is the sole language used for the purposes of concluding the contract.

Confirmation of Receipt

Unless explicitly stated otherwise, our offers are non-binding and subject to change. Orders made by the purchaser are binding. Upon receipt of your order, you will receive an email notification confirming receipt of the order (hereinafter referred to as the "Confirmation of Receipt"). The Confirmation of Receipt does not constitute an acceptance by Viking of the customer's offer of purchase. Acceptance of the offer of purchase takes place either by email or upon delivery of the goods within five days.

Delivery

Delivery dates and delivery timescales are only binding if they are confirmed in writing by Viking.

If we receive and confirm your order before 5pm on a business day, we will usually deliver on the next business day following confirmation of the order.

We usually deliver printed promotional materials and customised products within four to six weeks of receipt of your approval of the proof or sample provided to you by us in advance.

Invoice

The invoice is payable in full within 30 days. Payment can be made by direct debit or with your VISA, AMERICAN EXPRESS or MASTERCARD. We reserve the right to require advance payment on orders from new customers or current customers.

Viking is free to send invoices and reminders by post or electronically via email. If you would like to receive paper copies of your invoices, please inform us by sending an email to rechnung@viking.de .

Reservation of title

The delivered product remains the property of Viking until payment is made in full.

Prices

All prices on our website are listed in euro (€) and are shown as net prices plus VAT as well as gross prices including VAT. All prices shown in our catalogues are net prices in euro (€) plus VAT.

Prices in catalogues and on our website are subject to change and errors are excepted. We will notify you of any changes to or errors in prices when you place your order.

The retail prices given are based on the recommended retail prices from the manufacturers. All retail prices are accurate at the time of the creation of the media.

Insofar as the copyright fees on IT devices have been paid by our suppliers, this cost is included in the prices listed.

Product changes

We reserve the right to make product changes without prior notice where these changes have the sole aim of improving the item, do not compromise the purpose of the contract and are reasonable.

Delivery costs

For goods with a value of under €49, shipping costs of €2.95 will be charged. Delivery is free of charge for goods with a value over this amount. Additional insurance is charged at a flat rate of €1.95 on all shipments, irrespective of the value of the goods.

Warranty and guarantee

The implementation of the guarantee is governed by law.

The period of limitation for warranty claims is 12 months, calculated from the transfer of risk.

Notwithstanding these statutory claims, we offer a guarantee on material and workmanship defects within a period of three years from the date of delivery. This warranty does not include normal wear and tear or defects due to improper handling of the delivered goods by the purchaser. The warranty period may vary for some products. The customer will be notified separately if this is the case. We offer a guarantee of one year for Apple products.

In the event of a warranty claim, we will, at our sole discretion, repair the item or replace it with an identical or technically equivalent item. Fulfilment of the warranty will not result in any extension of the warranty period beginning from the date of delivery. Statutory warranty claims remain unaffected by this guarantee.

30-day right to return

30-day return — buy risk-free

All catalogue products may be returned within 30 days. If an item does not meet your expectations, call us and we will collect the item from you. Items must be returned unused, undamaged and in their original packaging. Software products and data storage devices must be unopened and the seals present upon delivery must be intact. Your right to return does not apply to products that are manufactured or modified according to customer specifications or that are clearly tailored to the personal requirements of the customer. This applies in particular to promotional items that are printed in accordance with your requirements. In addition, this right to return does not apply to hygiene products, constructed furniture or food and other products for human consumption. This right of return does not restrict your statutory warranty rights. Goods that have been tested may not be returned as this constitutes use of the item.

Promotional items and gifts

You may, of course, provide your own films. This should be discussed with our service team upon ordering. Before placing an order, you may request a print sample. Our service team will notify you of the costs and delivery times for this service.

In the event of incomplete information concerning the promotional design, we reserve the right to adjust the design at our own discretion and to the best possible position in our view.

We generally deliver the exact quantity ordered. However, for giveaway items bearing promotional print, a deviation of up to 10% in the quantity delivered cannot always be avoided. The customer agrees to accept such an excess or shortage in the quantity delivered.

If your order comprises office supplies and promotional materials, please note that the promotional materials will be delivered separately and may have different packaging and delivery notes to the office supplies.

For the printing of promotional materials (one/two colours) or for laser engraving, one-off set-up costs and film costs will apply. These costs must always be included in the basket as part of the order. If you forget to include these costs in your order, we will add these costs to the invoice as required.

We are not liable for errors that occur during printing of promotional material if these errors were present on the proof copy or sample approved by the customer.

Data protection

The processing of personal data is performed according to data protection laws and regulations. For further information, please see our data protection declaration.

Place of jurisdiction — place of fulfilment

The sole place of jurisdiction for all disputes is—insofar as legally permissible—Aschaffenburg. Office Depot is, however, entitled to bring action against the customer in the place of jurisdiction of their company headquarters. German law applies; the application of the UN Convention on Contracts for the International Sale of Goods is excluded. Unless indicated otherwise in the Order Confirmation, the place of fulfilment is our place of business.

Disposal of old electrical and electronic equipment

You can take any electrical equipment to your local electronic waste take-back facility. This is the only way to ensure old electrical equipment is recycled while protecting resources and the environment. Improper disposal of electronic waste can have dangerous consequences for the environment and public health. The required registration has been completed in accordance with § 6 (2) of the German Electrical and Electronic Equipment Act (ElektroG) at the national register for waste electric equipment. Our registration number is WEEE reg. no. DE95778990.

The crossed-out wheelie bin is a symbol for the separate collection of electronic and electrical equipment, which must not be disposed of in normal household waste.
Information regarding the German Batteries Act (Batteriegesetz)

Waste batteries must not be disposed of in normal household waste. End users are legally required to return waste batteries. Batteries can be returned free of charge after use. Batteries can be either be brought to a suitable collection point provided by a commercial organisation or local authority, or sent by post to our shipping warehouse at Linus-Pauling-Straße 2, 63762 Großostheim, Germany.

The wheelie bin means batteries must not be disposed of in household waste.

The symbols Pb, Cd and Hg stand for:
Pb: Battery contains lead
Cd: Battery contains cadmium
Battery contains mercury
Waste batteries may contain pollutants or heavy metals, which can damage the environment and public health. Batteries are recycled as they contain important raw materials such as iron, zinc, manganese and nickel.

General terms and conditions of Office Depot Deutschland GmbH (Viking)

These general terms and conditions apply to all commercial trade with our customers who do not use their purchased goods in industry, trade, craft or self-employment.

Sales and delivery are carried out exclusively within Germany.

We supply products and services solely in accordance with the following terms of sale, delivery and payment. These terms apply to all of our present and future offers, deliveries and services, unless otherwise agreed in individual cases.

Terms and conditions of the purchaser that deviate from our own terms of sale, delivery and payment will not apply. The following terms and conditions therefore exclusively apply even if we provide delivery and services without reservation with knowledge of conditions that are contrary to or deviate from the following terms and conditions.

Prices

All prices are indicated on our website in euro in the total gross amount with the statutory VAT included. They apply solely to orders placed online.

For goods with a value of under €59, shipping costs of €3.51 will be charged. Delivery is free of charge for goods with a value over this amount. An additional logistics fee is charged at a flat rate of €2.32, irrespective of the value of the goods.

Warranty and guarantee

The warranty is governed by statutory provisions.

Notwithstanding these statutory claims, we offer a guarantee on material and workmanship defects within a period of three years from the date of delivery. This warranty does not include normal wear and tear or defects due to improper handling of the delivered goods by the purchaser. The warranty period may vary for some products. You have the right to cancel this contract for any reason within 30 days.

The cancellation period of 30 days starts from the day that you or a third party named by you, who is not the courier, receive(s) the last shipment of goods that completes the order.

Please provide a clear declaration (e.g. by phone, a letter sent by post, fax or email) stating your decision to cancel this contract. You can use the attached sample cancellation form, however this is not mandatory: sample cancellation form

Please ensure that you submit your cancellation request within the cancellation period.

Consequences of cancellation

If you choose to cancel your contract, we will immediately refund all payments received, including delivery costs (excluding additional costs incurred if you chose any delivery other than our cheapest standard delivery) within 14 days of receipt of your cancellation request. We will refund your payment using the same payment method used in the original transaction, unless other arrangements have been explicitly arranged with you; you will never incur charges as a result of this refund.

We will collect the goods.

You will be liable for any possible loss of value for goods, if the loss of value can be attributed to your unnecessary handling of the item to test the quality, properties or function of the goods.

The right to cancel is not applicable to the following contracts:

    • Contracts for the supply of goods that are not prefabricated and that have been made according to a consumer's individual selection or specification, or that have been clearly customised to meet the consumer's personal requirements.
    • Contracts for the supply of goods that are easily perishable or have a short expiry date.
    • Contracts for the supply of sealed goods that cannot be returned for health and safety or hygiene reasons if the sealed packaging has been removed after delivery
    • Contracts for the supply of goods, if after delivery they are inseparably mixed with other goods due to their condition.
    • Contracts for the supply of alcoholic beverages, the price of which was agreed at the conclusion of the contract, that can be delivered no earlier than 30 days after the conclusion of the contract, and the current value of which is dependent on fluctuations in the market, over which the business owner has no influence.
    • Contracts for the supply of audio or video recordings or computer software in sealed packaging, if the sealed packaging has been removed after delivery.
    • Contracts for the supply of newspapers, magazines and illustrated magazines, excluding subscription contracts.
